Who these are between
Goto-Tender Limited, company number 16627586, registered office 27 Bates Lane, Helsby, Frodsham, England, WA6 9LN ("we"), and the business that opens an account ("you"). GetStockists is a business service; by opening an account you confirm you act for a business, not as a consumer.
1. What the service is
GetStockists shows you UK shops that fit your range, ranked; finds and checks a business contact address when you unlock a shop; builds a wholesale pack from your website that you then edit; drafts the emails you send to shops; keeps your pipeline; and tells you about newly registered shops. You send every email yourself, from your own address. We do not send to shops for you and we do not promise that any shop replies, samples, or orders.
2. Your account
- Sign-in is by a link emailed to your address. Keep that inbox secure; anyone who can read it can sign in as you.
- One account is one business. A seat lets a colleague work the same board; a rep who only receives the Monday email needs no seat.
- You are responsible for what is done under your account, including the emails sent from it and the accuracy of your pack.
3. Plans, unlocks and payment
- Monthly is £99 a month after a seven-day free trial with 10 unlocks. Card required; nothing is charged until the trial ends, and you are emailed before the first charge.
- Annual is £790 a year, charged when you start.
- Both include 75 unlocks a month. Unlocks reset on your billing date and do not roll over. A pack of 50 extra unlocks is £25 and counts in the month it is bought. A seat is £12 a month.
- An unlock that finds no deliverable contact is refunded to your allowance the same minute. An unlock that finds one is spent, whether or not you send.
- Prices are in pounds sterling; we are not VAT registered at present and will say so here when that changes. Payment is by card through Stripe. If a payment fails we tell you and retry; if it keeps failing the account pauses until it is paid.
- We may change prices with thirty days' notice by email. A change does not affect a period already paid for.
4. Cancelling and refunds
- Cancel any time in your account, in one click. Your plan runs to the end of the period paid for, then stops. No call, no offer.
- We do not refund the current period. If we have made a mistake, write to us and we will put it right, including a refund where that is the right thing.
- After the plan ends your contacts stay readable for thirty days so you can copy what you need. There is no export. After that the account's data is deleted as the privacy notice says.
5. How you may use it
- Approach shops about stocking your products, in your own name, from your own email, with your name, your company's details and a way to opt out in every message, as the Privacy and Electronic Communications Regulations require. Our drafts include these; do not remove them.
- Stop emailing any shop that asks you to, and tell us so we can add it to the do-not-contact list.
- Do not copy, scrape, export or resell the shop data, share your sign-in, or use the service for anything other than your own wholesale approach. Do not send anything unlawful, misleading, or unrelated to stocking your products.
- If you break these we may suspend or close the account. We will tell you why.
6. Your content and ours
- Your brand, your products, your images, your pack and your notes are yours. You give us the right to store and process them to run the service, and nothing more.
- Drafts we write for you are yours to use as you like. The ranking, the ledger, the software and the design are ours.
- Your pack pages and PDF carry your name, not ours.
7. Data
How we handle data is in the privacy notice, which is part of these terms. For the shop data we supply, we are the controller. For the notes, replies and buyer names you record about shops, you are the controller and we process them for you under these terms: only on your instructions, only to provide the service, with the processors named in the privacy notice, and deleted when your account closes.
8. What we promise, and what we do not
- We keep the service running and fix faults promptly. We tell you about planned downtime. We keep your data as the privacy notice says and never sell it.
- Shop data comes from public registers and the shops' own sites. We check contact addresses when you unlock them, but a shop can move, close or change its address, and a register can be wrong. We do not guarantee the data is complete or current.
- Drafts are written by software from the facts we hold. Read them before you send them.
- The service is provided as it is. We exclude every implied warranty the law allows us to exclude.
9. Liability
We are liable for what we get wrong, up to the amount you have paid us in the twelve months before the claim. We are not liable for lost orders, lost profit, lost data you could have kept elsewhere, or for what a shop does or does not do. Nothing here limits liability for death, personal injury, fraud, or anything else the law will not let us limit.
10. Ending or changing the service
- We may change the service as we improve it. If we remove something you rely on we tell you first.
- If we ever close the service we give you sixty days' notice, a way to take your pipeline with you, and a refund of any period you have paid for beyond the closing date.
- We may change these terms with thirty days' notice by email. Carrying on using the service after that is acceptance; if you do not accept, cancel before the change and we refund the unused part of an annual plan.
11. The rest
- These terms are the whole agreement; nothing said elsewhere adds to them unless we put it in writing.
- If a court finds a clause unenforceable the rest stands.
- English law applies, and the courts of England and Wales decide any dispute.
